4TO: una ves realizado la AUDIENCIA DE INSPECCIÓÍN OCULAR, la audiencia no podrá suspenderse por ningún motivo. de lo VSITO y OIDO, se establece como convicción para el suscrito JUEZ, como hecho fáctico se evidencio lo acontecido el 19 de junio de 2014. de la misma manera, se pudo evidenciar que el predio objeto del proceso tiene todas las características para ser considerado predio AGRICOLA, por el uso que le esta dando a las tierras cultivando alfa, papa y cebada.
3RO: bajo la documentación presentada, se ha identificado que se encuentran en 3 parcelas y luna de las parcelas que es la que esta siendo avasallada tiene una superficie 1.0800 Has.
2DO: el FOLIO REAL, acredita el derecho propietario que le asiste al demandante, registrado el titulo ejecutorial No. 0463336. en derechos reales bajo la matrícula No. 2.12.1.01,0000331 con una superficie de 2.5230 Has., que se hace oponible a terceros, siendo el actual propietario NUMESTERIO MAMANI CONDORI.
1RO: la demanda ha sido la base del juicio oral, el demandante probo que el predio de la LITIS, se encuentra ubicado en el EX FUNDO CHURIAQUE, EN EL CANTON PUCARANI DE LA PROVINCIA LOS ANDES DEL DPTO. DE LA PAZ y que la misma se encontraría en el AREA RUAL
